By providing my electronic signature below, I confirm that I have read, fully understand, and voluntarily agree to all terms of this Waiver and Release.

In consideration of participating in group fitness classes (including but not limited to cycling, boxing, circuit training, weightlifting, strength training, and similar activities), group training, individual personal training, or any other programs, activities, or facility use at Apex Athletics, MI LLC, a Michigan limited liability company, doing business as The Workout Warehouse (the “Studio”), I agree as follows:

1.  Acknowledgment of Inherent Risks
I understand that physical exercise and fitness activities involve inherent and serious risks, including but not limited to sprains, strains, fractures, heart attacks, strokes, dehydration, heat illness, falls, equipment malfunction, contact with other participants or objects, and the potential for serious injury, permanent disability, or death. These risks may arise from my actions, the actions of others, facility conditions, equipment, or other factors.

2.  Health and Physical Condition Representation
I represent that I am in good health, have no medical conditions, injuries, or limitations that would make participation unsafe, and have consulted a physician if necessary. I agree to stop immediately and notify Studio staff of any pain, discomfort, or health issues during activities.

3.  Voluntary Assumption of Risk
I voluntarily assume all risks associated with participation, including those caused by the ordinary negligence of the Studio.

4.  Release and Waiver of Liability
To the fullest extent permitted by Michigan law, I release, waive, discharge, and agree not to sue Apex Athletics, MI LLC, a Michigan limited liability company, doing business as The Workout Warehouse, its owners, officers, employees, instructors, agents, contractors, and assigns (the “Released Parties”) from any claims, damages, gross negligence, or liability for personal injury, property damage, or death arising from my participation—even if caused by the ordinary negligence of the Released Parties.

5.  Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, losses, or expenses (including attorneys’ fees) arising from my participation.

6.  Governing Law, Severability, and Venue
This agreement is governed by Michigan law. If any provision is invalid, the remainder remains enforceable. Any disputes shall be venued in Wayne County, Michigan.

7.  Signature and Voluntary Agreement
I am 18 or older (or have parent/guardian consent if under 18) and competent to agree. My signature is legally binding and I sign freely, without inducement, after careful review.

8. By signing this document, I acknowledge that I have read and understand the risks described.  I consent to the Studio using my photograph, video, or likeness for promotional purposes without compensation. I assume all risks and release the Studio as stated and I agree to all terms voluntarily.
